Service Description

Navigating the legal side of education can feel overwhelming. Many parents are unsure of their rights, what their child is legally entitled to, or how to challenge decisions made by schools and local authorities. Policies around ALN (Additional Learning Needs) in Wales and SEND (Special Educational Needs and Disabilities) in England vary widely, making it difficult to know how to access the right services and support. Without clear guidance, children risk missing out on the educational accommodations, interventions, and opportunities they are entitled to. At JLW Consultancy, our Legal & Policy Advice Service helps parents make sense of complex education law and policy. We provide expert advice to ensure you understand your child’s rights and know how to take effective action when needed. We support families by: • Explaining ALN and SEND legislation — breaking down what the law means for your child. • Clarifying school and local authority responsibilities — so you know exactly who is accountable. • Advising on complaints, appeals, and dispute resolution — including mediation, tribunals, and ombudsman processes. • Guiding families through assessments and support requests — such as EHCPs in England and IDPs in Wales. • Ensuring parents feel confident in challenging unfair treatment — from discrimination to inappropriate exclusions. Frequently Asked Questions • What are my rights as a parent? You have the right to request assessments, access records, and advocate for appropriate support. • How can I appeal a school’s decision? You may file a complaint, request mediation, or escalate to the local authority or tribunal. • What are the legal requirements for SEN support? Schools must follow statutory guidance — the ALN Code (Wales) or SEND Code of Practice (England). • Can schools legally deny support? They must provide reasonable accommodations. If denied, you can challenge the decision. • What if my child is excluded unfairly? Schools must follow due process, and you have the right to appeal exclusions. • Are there laws protecting children with disabilities? Yes — the Equality Act 2010 protects children from discrimination and ensures equal access to education. • Can I request a review of my child’s plan? Yes — parents can request formal reviews of EHCPs, IDPs, and other plans to ensure provision remains appropriate.
